Rules of the Lydia Scratch Ticket

1. Organisation 

The organiser is Lydia Solutions, a French company (“société par actions simplifiée”) with capital of €1,789,707, having its registered office at 14 Avenue de l'Opéra - 75001 Paris - France, registered in the Trade and Companies Register of Paris under no. 534 479 589.

Lydia Solutions is authorised and supervised by the Autorité de Contrôle Prudentiel et de Résolution Authority as an electronic money institution empowered to provide payment services and as a finance company (CIB code no. 17598, REGAFI identifier no. 62677) (hereinafter referred to as the "Organiser" or "Lydia Solutions").

Lydia Solutions organises an advertising lottery (hereinafter referred to as the "Scratch Card Program"), via the mobile application developed and made available by Lydia Solutions (hereinafter referred to as the "Application"), aimed at users of the Application, natural persons, acting for non-professional purposes (hereinafter referred to as the "Users"), the terms and conditions of which are set out below.

2. Object

The Scratch Card Program is an advertising lottery within the meaning of article L121-20 of the French Consumer Code.

The promotional lottery takes the form of a digital scratch card (hereinafter referred to as a "Scratch Card"). A Scratch Card is issued after each eligible Card payment transaction that the User makes with one of the Cards that he holds with a merchant (hereinafter referred to as an "Eligible Payment Transaction"). The User may, from the Application, scratch their Scratch Cards to find out if they are a winner or not. A winning Scratch Card triggers the reimbursement of all or part of the Eligible Payment Transaction that generated it, subject to compliance with these rules.

The French version of these rules prevails over the English version.

3. Duration

These Rules are applicable for an initial period of one (1) month, tacitly renewable for the same period, unless these Rules are terminated by Lydia Solutions or the Participant.

4. Terms and conditions of participation

The User acknowledges and agrees that the Scratch Card Program is exclusively open to natural persons using the Application, which is available for free download on compatible mobile application shops, and holding a physical or virtual payment card issued in the User's name by Lydia (hereinafter referred to as the "Card"). 

In order to participate in the Scratch Card Program, the User shall make at least one payment with a Card of which they are the holder.

This payment shall be for a minimum amount of fifty euro cents (€0.50) and its purpose shall be the purchase of a good or the provision of a service, in compliance with the applicable regulations.

Regarding the Scratch Card Program, the Organiser does not take into account and expressly excludes the following: 

  • Payment transactions for prohibited activities, as defined in the List of prohibited activities when using Lydia services;
  • Payment transactions for gambling and betting, including lottery tickets, casino chips, bets and off-track betting;
  • Payment transactions carried out via a banking, payment, electronic money or investment service provider other than Lydia Solutions, its principals and commercial partners;
  • Payment transactions consisting of, or for the purpose of, topping up bank accounts, payment accounts, electronic money accounts and investment accounts;
  • Transactions external to the payment or electronic money account opened in Lydia Solutions’s books and all other transactions that may give rise directly or indirectly to the generation of cash (also known as "quasi-cash");
  • Payment transactions that are not completed, unsuccessful, refused, abandoned, stopped due to unforeseen circumstances and/or reimbursed by the beneficiary of the payment, and
  • Payment transactions carried out in non-compliance with the contractual documents applicable at the date of the Scratch Card Program, and framing Lydia Solutions’s services mentioned on its website in the following page: General terms and conditions of use

The Organiser reserves the right to carry out any useful checks on Users in order to verify the correct application of these rules. Failure to comply with these rules will invalidate the User's participation, and Lydia Solutions may demand reimbursement of any prizes wrongly received by the User, without prejudice to any legal action to obtain compensation for any damage suffered by Lydia Solutions and/or to protect its interests.

The Organiser also reserves the right to (i) disqualify, at any time and without prior notice, Users who have carried out any fraudulent or abusive action or any action intended to circumvent the provisions of these rules or to distort the normal operation of the Scratch Card Program and the chances of winning (hereinafter collectively referred to as "Fraudulent Use"), and (ii) withdraw the winnings of any User who has made a payment with a sum resulting from any Fraudulent Use.

5. Terms and conditions of the prize draw and expected winnings

Each eligible Payment Transaction entitles the User to one Scratch Card. For each Scratch Card, the User has one chance in n (n: a positive integer less than or equal to 1000) of obtaining a winning Scratch Card. In other words, 1 in n corresponds to the probability of each Scratch Card being a winner. A random draw is made during each eligible Payment Transaction to determine whether the Scratch Card is a winner, automatically by means of a random designation algorithm implemented by Lydia.

If the eligible Payment Transaction carried out by the User is designated as a winner by the Organiser (hereinafter referred to as the "Winning Payment"), its amount will be reimbursed to the User who carried out the eligible Payment Transaction and holder of the Scratch Card (hereinafter referred to as the "Winner"), within the limits explained in these rules and without this amount exceeding one hundred euros (€100), provided that Lydia Solutions reserves the right to reduce, at any time, this amount to fifty euros (€50). 

The User has a period of twenty-four (24) hours after the completion of the eligible Payment Transaction to scratch the associated Scratch Card and find out whether it is a winner or not. Once this period has elapsed, if the Scratch Card has not been scratched by the User, the User will no longer be able to scratch the Scratch Card or find out whether it was a winner or not, and the Eligible Payment Transaction will no longer be reimbursed, regardless of the result of the draw.

Users are entitled to a maximum of ten (10) Scratch Cards per twenty-four (24) hours. After that time, the following eligible Payment Transactions will no longer generate Scratch Cards, regardless of their eligibility, until the aforementioned time limit has expired.

The Organiser reserves the right at any time to vary the probability of Users winning depending on the amount of eligible Payment Transactions without the User being notified. This probability of winning will vary identically for all Users, ensuring that each User has an equal probability of winning depending on the amount of eligible Payment Transactions.

It is expressly agreed that the hoped-for win consists solely of the aforementioned description, within the limits of the reimbursement limits and the aforementioned deadlines and thresholds applicable to the Scratch Card, for the entire duration of the advertising operation.

6. How winnings are awarded 

The Winners, in order to benefit from the reimbursement of their eligible Payment Transaction within the aforementioned limits (see article 4. Terms and conditions of the prize draw and expected winnings) are informed instantly after having scratched, without it being necessary to inform them by any other means.

In this respect, by participating in the Scratch Card Program, the User acknowledges and agrees that notification on the Application is sufficient to be informed, regardless of whether it is a winning or losing Scratch Card. 

The Winner acknowledges and agrees that the winning Payment will be refunded to their payment account opened in their name in Lydia Solutions’s books after the final validation of the eligible Payment Transaction by the merchant.

In the case of an eligible Payment Transaction made through a payment pre-authorisation initiated by the User, the chances of winning are calculated from the amount of the pre-authorisation. In the event of a winning Scratch Card, the amount of the validated eligible Payment Transaction will be reimbursed to the Winner.

The Winners undertake to provide the Organiser, on first request, with all the information required to verify their identity and their eligible Payment Transactions. The Winners attest to the veracity of all the information they provide to the Organiser and authorise all legal verifications concerning the information provided.

Any information that is incomplete, false, erroneous, illegible, unusable and/or does not correspond to what was declared when the User registered for the Application, for the entire duration of the Scratch Card, will render the Winner's participation null and void, and the Winner will therefore not be able to claim to have won and will lose the right to reimbursement.

In any event, the Winner retains the right to accept or refuse reimbursement of the winning Payment.

7. Submission of Scratch Card rules

These rules are accessible throughout their duration in the Application and on Lydia Solutions’s website at the following URL address: https://www.lydia-app.com/ticket-a-gratter.

They are deemed to be accepted unconditionally by the User, as soon as the User carries out an eligible Payment Transaction, from the time they are published in the Application and on the aforementioned website.

Any updates to these rules will be published on the Application and the aforementioned website, bearing in mind that the same will apply in the event of a temporary or permanent interruption to the Scratch Card Program.

8. Responsibilities 

The Organiser may not be held liable if, in the event of an event constituting a case of force majeure as defined by article 1218 of the French Civil Code and as interpreted by the case law of the Cour de cassation, the Scratch Card has to be modified, suspended, shortened in time, terminated or cancelled. The Organiser also reserves the right to modify or cancel the Scratch Card participation period.

The Organiser may, at any time and without notice, modify all or part of or terminate the conditions of the Scratch Card, in particular if it appears that fraud or attempted fraud, proven or suspected, through the use of artificial, fraudulent or criminal means or schemes, has occurred, in any form whatsoever, in connection with any participation to the Scratch Card Program. 

The Organiser may not be held liable if, as a result of attempted fraud or proven fraud, or the use of artificial, fraudulent or criminal means, the running of the Scratch Card Program or the designation of the Winner were to be cancelled, postponed or modified, and/or the duration of the Scratch Card Program shortened, suspended or interrupted.

By participating in the Scratch Card Program, each User agrees and undertakes to bear alone any damage or loss caused or suffered as a result of their participation to the Lydia Scratch Card Program, unless otherwise provided by public policy.

9. Applicable law, claims, jurisdiction

These rules are governed by French law. The French version of these rules prevails over the English version. For any complaint, Users may contact :

In the event of any dispute that cannot be resolved amicably, the French courts shall have jurisdiction, unless otherwise provided by public policy.
